Terms of Use

Actual Market Research provides its services to a client subject to the terms and conditions stated below. The usage of our services constitutes the client's acknowledgement of assent to be bound by this Agreement. Actual Market Research holds the rights to change or modify this Agreement at any time. We also reserve the right to modify or discontinue, temporarily or permanently, any of the services provided on our site without any prior notice.

Whenever you carry out any transaction on Actual Market Research, the terms and conditions effective at that time apply to your transaction, and it is solely your responsibility to go through the terms and conditions before carrying out any transaction. We also reserve the right to deny access to this site to anyone at any time.

Order/ Shipping / Delivery

Once you have placed an order for a report listed on our website, the payment for the same becomes due and owing immediately. The report will not be dispatched until we receive the complete payment. When you order a report from Actual Market Research, we strive to deliver the report in the shortest possible time. With electronic delivery being the fastest option, we encourage clients to order reports electronically. Usually, all electronic information reports are dispatched within 48 hours (2-business days). In case of hardcopy products, delivery to some markets may be delayed due to local carriers and other formalities we shall not be responsible for any delay or failure to you where such delay or failure arises from any cause that is beyond our reasonable control. Orders are shipped within 2 working days and delivering of the shipment subject to Courier Company / post office norms. Actual Market Research is not liable for any delay in delivery by the courier company. It will be shipped to your registered address as per the details specified at the time of order. Actual Market Research is in no way liable for any damage to the order while in transit.

Actual Market Research makes every effort to be as accurate as possible. However, we do not warrant that report descriptions or other content of this site is absolutely accurate, complete, reliable, current, or error-free.

Taxes

GST would be applicable if the end client / distributor is based in India. All the aforementioned payment payable in or to any jurisdiction or authority whatsoever shall be your sole responsibility. This payment will exclude taxes levied on the income of Actual Market Research.

Partial Payment/ Overdue Amount

All fees should be paid as per the terms of payment mentioned in the applicable order. Actual Market Research has the discretion to cancel access to the product in case the full payment has not been received by Actual Market Research within the stipulated time. Overdue amounts shall bear interest calculated from the date when due until the date that payment is received by Actual Market Research. You shall pay the interest at a rate of two percent (2%) per month compounded monthly but shall not exceed the maximum amount permitted by law.

  • Any price change, of any Product(s) or (v) any other matter relating to any Product(s).

Force Majeure

  • Neither Party shall be liable for any failure or delay in performance under this Agreement if such failure or delay is caused by conditions beyond its control, i.e. force majeure circumstances, including but not limited to the Acts of God.
  • The Party affected by force majeure circumstances shall give the other Party(ies) a prompt written notice (including by fax) of the character, nature and expected duration of these circumstances, as well as indicate which obligations are affected and provide a sufficient confirmation of force majeure circumstances. If the duly notification is failed, no liability due to force majeure circumstances can be claimed.
  • In the event of the force majeure circumstances which prevent any Party from the execution of its duties as per this Agreement, dates by which performance obligations are scheduled to be met will be extended for a period of time equal to the time that such circumstances are effective. If force majeure circumstances are effective for the period of more than two months, the Parties, at the suggestion of a Party, shall agree further ways of this Agreement execution and/or termination.

Breach of License

The client acknowledges that the breach of these License Terms may cause Actual Market Research irreparable damage for which recovery of money damages would be inadequate, and the client agrees that Actual Market Research shall be entitled, in addition to any other remedies available to it, to seek (in any court of competent jurisdiction) injunctive relief and/or other equitable relief to prevent or restrain any breach by the client or otherwise to protect its rights, without being required to post a bond or other security.

  • Compliance and Change of Scope:Actual Market Research shall exercise the right to ensure the users' compliance with the aforementioned License Terms, using any method available to and preferred by Actual Market Research. In case any non-compliance on your part is detected in relation to any Product(s) purchased, Actual Market Research may, in its sole discretion, without causing any effect to any other rights of Actual Market Research under these License Terms may initiate the following:
  • Modify the scope of or upgrade the relevant license to bring it into compliance with the actual usage of the Product(s)
  • Invoice you with such additional fees that have arisen due to change of the scope of the license. Further, Actual Market Research has the right to initiate any other step that deeps necessary to rectify such non-compliance.

Children's Online Privacy Protection Act Compliance

User will make the payment to Actual Market Research as mentioned on the website. He/she is responsible for use, sales, and related taxes and customs.
